A legal case against prediction market platform Kalshi in Arizona has been put on hold after the Commodity Futures Trading Commission (CFTC) stepped in, marking another key moment in the ongoing battle over how these platforms should be regulated.

The pause follows a federal court decision to temporarily block Arizona from continuing its case, giving Kalshi some breathing room as this legal fight continues.

Who’s Really In Charge?

The intervention came after the CFTC argued that Kalshi operates under federal oversight, not state gambling laws. A judge agreed, granting a temporary restraining order that stops Arizona from pursuing its case for now.

At the centre of the debate is a bigger question that is are prediction markets financial products or a form of gambling?

Arizona had previously filed criminal charges against Kalshi, accusing the company of running an illegal gambling operation which is associated to sports and election based contracts. With the federal ruling in place, those proceedings are now paused as courts work through the jurisdictional clash.

The situation highlights a growing divide between state regulators and federal authorities. While states argue these platforms are representing unlicensed betting, the CFTC continues to frame them as regulated financial exchanges.
