Modo Casino Follows VGW Lead, Updates Terms Page for California
Modo Casino revises terms page for California, mirroring VGW’s move

Modo, one of America’s well-loved social casinos, has updated its Terms of Use page for California effective August 2025, following the lead of VGW and other popular sweepstakes casinos. Modo Casino’s policy turn is in response to tightening industry regulations and the approval of AB 831 in California.
The company’s latest T&Cs now highlight a California Release Waiver, a Class Action and Arbitration Clause, and explicit notice to its California players that the use of the platform is subject to these waivers.
Modo US’s updated terms aim to protect itself in California, a defense strategy first employed by VGW. These moves from the top sweepstakes casino operators offer a glimpse of the potential regulatory battles in California next year.
Modo Casino Proceeds Cautiously by Updating Its T&Cs

Modo US released its updated T&Cs last August 4, 2025, directly following VGW’s approach in the California market. The management’s calculated move was on point, with Governor Gavin Newsom formally signing AB 831 and banning the operations of sweepstakes casinos by January 1, 2026. Here’s a quick look at the major changes on the operator’s terms:
- California Release Waiver. The operator added a clause to align with the state’s Civil Code sections 1541 and 1542. Under the modified terms, local players “waive all rights and remedies under Section 1542”, which means they surrender the right to sue for unknown claims.
- Class Action and Arbitration Clauses. The new terms also specify that disputes will be addressed individually, rather than as part of a group or collective action.
- Explicit Notice for Players. There’s a special notice to California players, defining the consumer assistance contact information, and clarifying the use of the service.
- No real-money gambling. Modo US underscores its status as a free-to-play casino solely for entertainment.
- Opt-out provision. Players have a 30-day window to opt out of the arbitration agreement after sending a written notice.
Modo US Plays Safe As Regulations Tighten
The adjustment to the operator’s T&Cs is similar to the steps taken by other companies, such as VGW, in anticipation of California’s full implementation of AB 831. Courts have not yet reviewed and finalized their interpretation of these terms, so the effectiveness of these policy changes will be tested in the coming months.
Modo Casino’s page remains restricted in California as of today, and its recent moves are widely seen as a legal shield, rather than a guarantee of access. Commentators say that Modo’s and VGW’s recent policy decisions are in preparation for regulatory state battles in the state next year.
