Muscogee Nation Continues Battle Over Sacred Casino Site

Long running legal battle returns to court as questions around sacred land and tribal sovereignty remain unresolved

The Muscogee Nation is continuing its legal fight over the Wind Creek Casino site in Alabama, pushing back against efforts to dismiss a case tied to the alleged disturbance of historic burial grounds during the casino’s construction.

The dispute has been ongoing for more than a decade, but recent court developments have brought renewed attention to one of the most sensitive cases in tribal gaming.

A Case Built Around Sacred Ground

At the centre of the lawsuit is Hickory Ground, a site near Wetumpka, Alabama, that served as the Muscogee Nation’s last capital before the tribe was forcibly removed to Oklahoma during the 1830s. The Muscogee Nation alleges that during construction of what became the Wind Creek Casino, ancestral remains and cultural artefacts were removed and improperly handled.

According to the tribe, more than 57 sets of human remains and thousands of artefacts were removed during development tied to the site.

Efforts to Dismiss the Case

In recent filings, the Poarch Band of Creek Indians and Auburn University asked the court to dismiss the lawsuit, arguing that the claims are legally insufficient and should not move forward. Auburn University has also argued that it is protected from the lawsuit through institutional immunity, while the Poarch Band maintains the complaint lacks legal standing.

The Muscogee Nation, however, is pushing to keep the case alive, arguing the court should fully examine what happened at the site before any dismissal is considered.

A Long Running Legal Battle

This is not a new dispute. The Muscogee Nation first filed suit in 2012 after expansion plans for the casino moved forward. A lower court dismissed the case in 2021 based largely on sovereign immunity protections, but that decision was later challenged in federal appeals court.

In 2024, the Eleventh Circuit Court of Appeals vacated parts of the earlier dismissal and ordered the lower court to reconsider the complaint more carefully. The appeals panel stated that tribal sovereignty could not automatically shield actions involving sacred burial grounds and cultural destruction. That ruling gave the Muscogee Nation another opportunity to continue the case.

More Than a Casino Dispute

What makes this case different is that it goes far beyond gaming operations. For the Muscogee Nation, the issue is tied directly to cultural preservation, ancestral respect, and the protection of sacred land connected to tribal history. The tribe has repeatedly argued that the site should have remained protected under agreements tied to historic protection funding and federal law.

The case also touches on wider issues surrounding tribal sovereignty, land rights, and the limits of legal immunity in disputes involving sacred sites.

A Sensitive Issue Within Tribal Gaming

The dispute has also highlighted tensions between tribal nations themselves. The Poarch Band of Creek Indians has defended its actions over the years, arguing it preserved parts of the historic site while also building economic opportunities for the tribe through gaming development.

At the same time, the Muscogee Nation maintains that the development caused long term damage to one of its most sacred locations.

That disagreement has kept the case active for years and continues to draw attention across tribal gaming and cultural safeguarding circles.

What Happens Next

The court will now decide whether the lawsuit can continue moving forward or if dismissal efforts will succeed. For the Muscogee Nation, the fight remains about accountability and ensuring the facts surrounding Hickory Ground are fully examined.

And for the wider tribal gaming industry, the outcome could carry implications that reach far beyond one casino development.
