In 2018, the Supreme Court overturned PASPA’s decision, giving states the ability to regulate sports betting. These developments have led to a complete legal framework that is easier for lawmakers and regulators to execute.

Sports betting operates under established gaming laws, making it easier for regulators to follow. This approach also ensures customer protection and maintains the integrity of the gaming industry.

As stated by the American Gaming Association, “Rigorous state regulation requires legal sportsbooks to collect and share betting data with regulators, sports leagues, and sports integrity monitors. Transparency is further promoted through federal oversight that requires sportsbooks to comply with stringent anti-money laundering laws.” Together, these measures create a transparent and secure environment for both players and operators.

Legal sports betting is now generating significant tax revenues for states. A good example is Ohio, where figures show that 97% of all wagers were placed online, contributing to a 20% cut of all taxable revenue for the state, according to Axios.

Legal Betting Gains Public Confidence

In general, sports betting today is popular and widely accepted since it has been regulated. Its inclusion in mainstream sports media and entertainment is now discussed openly by the public.

Nearly $150 billion was wagered nationwide in 2024, with app revenues reaching $13.7 billion, up 25.6% from the previous year, according to Sportsbook Review and Business of Apps.

Over 50 million Americans are expected to bet on the Super Bowl, and the growing presence of betting in social media shows how openly the public now engages with regulated sports wagering, as noted by Medium and SB Media Showcase.

Since sports betting is clearly legal, players trust that the games are fair and that they have legal options if problems arise.

In 2024, Maryland State Senator Brian Feldman said, “By legalizing and regulating sports betting, we can ensure that it operates transparently and responsibly, providing consumers with a safe environment to engage in this activity.” This shows the confidence that senators have in this law and how well it is being handled by the states.

Clear Regulation, Sweepstakes Stay Behind

Sports betting also benefits from a structured regulatory environment, which attracts legitimate business investments. Investors are more likely to enter markets where the legal landscape is clearly defined and stable. Established regulations require operators to follow strict standards, including responsible gambling measures and secure payment systems, ensuring that customers are protected while the industry grows responsibly.

On the other hand, sweepstakes casinos operate in a gray area, often utilizing legal loopholes by presenting their offerings as games of skill or promotional giveaways. This uncertainty has created a patchwork of regulations across states, making enforcement difficult and weakening public confidence.

Chris Cylke, Vice President of Government Relations at the American Gaming Association (AGA), explained during a 2024 webinar: “The ambiguity in the legal status of sweepstakes gaming creates a patchwork of regulations that complicate enforcement and undermine public confidence in the gaming industry.” These challenges have slowed the approval of sweepstakes casinos, showing why sports betting, with its clear framework and investor confidence, continues to lead the path toward legalization.
