Connecticut Judge Rejects CFTC Bid in Latest Kalshi Ruling

Court says the regulator cannot override its decision as Kalshi's legal battle with the state continues

A Connecticut federal judge has rejected an attempt by the Commodity Futures Trading Commission (CFTC) to keep Kalshi operating in the state while the company appeals a recent court ruling.

The decision marks another setback for Kalshi in Connecticut, with the court reaffirming that the CFTC cannot override a judicial interpretation of federal law. The ruling follows last week's decision denying Kalshi's request for a preliminary injunction, which allowed Connecticut to continue enforcing its gambling laws against the company's sports event contracts.

Court Stands by Earlier Decision

After its injunction request was denied, Kalshi returned to court seeking emergency relief while it appealed the ruling.

However, Judge Vernon D. Oliver declined the request, saying that while the CFTC regulates derivatives markets, it does not have the authority to overturn a court's interpretation of the law. The judge also reaffirmed his earlier finding that Kalshi's sports event contracts do not qualify for the federal protections the company had argued applied in this case.

Legal Fight Continues

The battle centres on whether Kalshi's sports event contracts should be regulated under the Commodity Exchange Act or treated as sports wagering under Connecticut law.

Kalshi maintains that its products fall under the CFTC's exclusive jurisdiction as federally regulated event contracts. Connecticut, meanwhile, argues the products are effectively sports wagers and should therefore comply with state gambling laws. The latest ruling leaves the state's position unchanged while the appeal process moves forward.

Another Key Decision for Prediction Markets

The Connecticut case is one of several legal battles involving prediction market operators across the United States.

Courts in different states continue to examine where the line should be drawn between federally regulated event contracts and traditional sports betting. As those cases progress, the decisions are expected to play an important role in shaping the future of prediction markets and determining how they are regulated nationwide.
